Apple has appealed a Formosan Margaret Court opinion from last December that pooh-pooh its ownership of the iPad trademark in the country , and which could expose the company to trademark violation lawsuits from a local company .
The maker of the iconic iPad file the appeal on January 5 with the Higher People ’s Court of Guangdong Province , allot to a statement from Proview International , a little known Chinese display monitor ship’s company that claims control over the iPad trademark in mainland China .
Apple had originally file a lawsuit against Proview to put forward its control of the earmark . But In December , the Shenzhen Municipal Intermediate People ’s Court announced it hadrejectedApple ’s title .
In its lawsuit , Apple claim that a Proview subsidiary in Taiwan had sold the iPad trademark rights to a U.K.-based company called “ IP Applications ” . The trademark rights were then sold to Apple in 2010 .
The Shenzhen court , however , rule that the transfer of trademark rights were only made through Proview ’s Taiwan foot soldier . Proview ’s Shenzhen - base company , did not look trademark talks , and did not officially transfer any trademark rights , concord to the court .
Apple did not answer to a request for commentary on the effectual action .
Xie Xianghui , a attorney representing Proview , said that Apple had asked for the carry-over of the iPad trademark to it in the prayer . It is also enquire for compensation from Proview to the tune of 4 million yuan ( $ 636,204 ) in sound fee .
Apple ’s appeal take that Proview ’s Taiwan subsidiary was acting as a representative for Proview ’s Shenzhen - based company , he said . But Proview maintains it had no such human relationship with the Taiwan subordinate , and was not in any talk about transferring the iPad trademarks , Xie added .
Apple is produce the appeal as Proview has has already filed two lawsuits in Formosan court , demanding that Apple and local vendor Gome Electronics stop deal lozenge using the iPad name . The cases are still pending , Xie said .
